MOGO Munch is owned and operated by Mogo Tech, a subsidiary of MOLY TOWN, a multinational company.

“User” refers to any individual or entity accessing or using the Platform.
“Customer” refers to users who order food or services through the Platform.
“Restaurant Partner” refers to independent restaurants offering African cuisine through MOGO Munch.
“Delivery Partner” refers to independent contractors or third-party logistics providers who deliver orders.
“Content” refers to text, images, graphics, logos, reviews, ratings, and other materials on the Platform.
“Order” refers to a request for food or services placed through the Platform.

2. Scope of Services

MOGO Munch is a technology platform that:

Connects Customers with African cuisine restaurants in the diaspora
Facilitates food ordering and delivery logistics
Provides restaurant management and operational tools
Enables payments and digital transactions

MOGO Munch does not prepare food, does not own restaurants, and does not employ delivery partners unless explicitly stated. Restaurants and delivery partners operate as independent third parties.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 18 years old to use the Platform. By using MOGO Munch, you confirm that you meet this requirement.

3.2 Account Creation

To access certain features, you may be required to create an account. You agree to:

Provide accurate and complete information
Maintain the confidentiality of your login credentials
Notify us immediately of unauthorized account use

You are responsible for all activities conducted under your account.

4. Platform Use Rules

You agree not to:

Use the Platform for unlawful purposes
Interfere with platform security or functionality
Provide false information or impersonate others
Abuse, harass, or harm restaurants, delivery partners, or other users
Scrape, copy, or misuse platform data without authorization

Violation may result in account suspension or termination.

5. Orders and Transactions

5.1 Placing Orders

By placing an order, you authorize MOGO Munch to transmit your order to the selected Restaurant Partner and process payment on your behalf.

5.2 Order Accuracy

Restaurants are responsible for preparing orders accurately. MOGO Munch facilitates communication but does not guarantee food quality, preparation methods, or ingredient compliance.

5.3 Special Instructions

Special requests (e.g., allergies, spice level) are transmitted to restaurants but cannot be guaranteed.

6. Pricing, Fees, and Payments

6.1 Pricing

Prices are set by Restaurant Partners. Prices on MOGO Munch may differ from in-store prices.

6.2 Fees

MOGO Munch may charge:

Service fees
Delivery fees
Platform or technology fees
Applicable taxes

All fees are disclosed before checkout.

6.3 Payments

Payments are processed through secure third-party payment processors. By providing payment information, you authorize us to charge applicable fees.

7. Cancellations and Refunds

7.1 Customer Cancellations

Orders may be canceled only before preparation begins. Once preparation starts, cancellation may not be possible.

7.2 Refunds

Refunds are issued at MOGO Munch’s discretion for:

Incorrect orders
Missing items
Undelivered orders
Quality issues verified by evidence

Refunds may be issued as:

Original payment method
Platform credit

8. Delivery Services

8.1 Delivery Partners

Delivery partners are independent contractors. MOGO Munch does not control delivery routes, timing, or conduct beyond platform standards.

8.2 Delivery Times

Estimated delivery times are not guarantees and may vary due to traffic, weather, or operational factors.

8.3 Failed Deliveries

If a Customer is unavailable or provides incorrect delivery details, the order may be marked as completed without refund.

9. Restaurant Partner Responsibilities

Restaurant Partners agree to:

Comply with all food safety and health regulations
Maintain accurate menus and pricing
Prepare food in a hygienic and professional manner
Fulfill orders promptly and accurately

MOGO Munch reserves the right to suspend restaurants that fail to meet quality standards.

10. Ratings, Reviews, and User Content

Users may submit reviews and ratings. By submitting content, you grant MOGO Munch a royalty-free, worldwide license to use, display, and distribute that content.

We reserve the right to remove content that is:

Abusive
Fraudulent
Misleading
Culturally offensive

11. Intellectual Property

All Platform content, trademarks, logos, software, and designs are owned by or licensed to MOGO Munch, Mogo Tech, or MOLY TOWN.

You may not copy, modify, distribute, or exploit any content without written permission.

12. Promotions, Credits, and Discounts

Promotions are subject to:

Specific terms and expiration dates
Non-transferability
One-time use unless stated otherwise

MOGO Munch reserves the right to modify or cancel promotions at any time.

The Platform may include third-party services or links. MOGO Munch is not responsible for third-party content, policies, or practices.

Use of third-party services is at your own risk.

Error-free operation
Accuracy of restaurant information
Food quality or suitability for dietary needs

15. Limitation of Liability

To the maximum extent permitted by law, MOGO Munch, Mogo Tech, and MOLY TOWN shall not be liable for:

Food-related illnesses
Allergic reactions
Delayed or failed deliveries
Indirect or consequential damages
Loss of profits or data

Total liability shall not exceed the amount paid for the affected order.

16. Indemnification

You agree to indemnify and hold harmless MOGO Munch, its affiliates, officers, and employees from claims arising out of:

Your misuse of the Platform
Violation of these Terms
Interaction with restaurants or delivery partners

17. Account Suspension and Termination

MOGO Munch may suspend or terminate accounts for:

Fraud
Abuse
Violation of Terms
Repeated order disputes

Termination may occur without prior notice.

18. Data Protection and Privacy

Your use of the Platform is governed by our Privacy Policy, which explains how we collect, use, and protect personal data in compliance with applicable laws.

19. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the jurisdiction in which Mogo Tech is registered, without regard to conflict of law principles.

Disputes shall be resolved through:

Mediation or arbitration (if required)
Courts of competent jurisdiction

20. Force Majeure

MOGO Munch is not liable for failure to perform due to events beyond reasonable control, including natural disasters, strikes, system outages, or governmental actions.

22. Assignment

You may not assign your rights under these Terms without consent. MOGO Munch may assign its rights to affiliates or successors.
